By using the Suo Tracker (”Service”), you are agreeing to be bound by the following terms and conditions. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access our services through your account to these terms and conditions, in which case the terms “you” or “your” shall refer to such entity, its affiliates and users associated with it. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services.

Suo Tracker reserves the right to update and change the Terms and Conditions from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms and Conditions. Continued use of the Service after any such changes shall constitute your consent to such changes. Violation of any of the terms below will result in the termination of your Account. While Suo Tracker prohibits such conduct and Content on the Service, you understand and agree that Suo Tracker cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

Account Terms

1. You must be at least 16 years old in order to use the Service. You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and have gotten your parent or guardian to agree to these Terms on your behalf).
2. Your login may only be used by one person — a single login shared by multiple people is not permitted.
3. You are responsible for maintaining the security of your account and password. Suo Tracker cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
4. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account).
5. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

Payment, Refunds, Upgrading and Downgrading Terms

1. An upgrade from the free plan to any paying plan will immediately bill you.
2. Downgrading your Service may cause the loss of features or capacity of your Account. Suo Tracker does not accept any liability for such loss.
3. The Service may include automatically recurring payments for periodic charges ("Subscription Service"). If you activate a Subscription Service, you authorize Suo Tracker or its third-party payment processors to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums.
4. Refunds for payments made through the App Store or Google Play are subject to the respective store’s refund policies. Suo Tracker does not process refunds directly for subscriptions purchased through these platforms.
5. If your Subscription Service includes a free trial period, you will not be charged until the trial period ends. If you do not cancel your subscription before the end of the trial period, your payment method will be automatically charged.
6. Suo Tracker reserves the right to modify subscription fees for the Service at any time upon reasonable notice. Price changes will take effect at the start of the next subscription period.
7. To cancel your Subscription Service, you must do so through the platform where you originally subscribed (e.g., App Store or Google Play).

Cancellation and Termination

1. If you cancel the Service before the end of your current paid-up period, your benefits will remain active until the end of the subscription period. You will not be charged again. For subscriptions purchased through the App Store or Google Play, cancellation must be performed via those platforms.
2. Should you wish to terminate your account before the end of your current paid-up period, your termination will take effect immediately, and all associated content will be deleted.
3. Suo Tracker, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. Termination of the Service will result in the deactivation or deletion of your Account and all associated Content. You will receive prior notice unless termination is due to violations of applicable laws or Terms of Service.
4. Suo Tracker reserves the right to temporarily or permanently suspend your account in case of suspected fraudulent activities, violations of laws, or abuse of the Service.

Copyright and Content Ownership

1. We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours.
2. Suo Tracker does not pre-screen Content, but Suo Tracker and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.

THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. Suo Tracker DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE. Suo Tracker DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE, OR ANY MATERIALS OR CONTENT OFFERED THROUGH OR PROCESSED BY THE SERVICE, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND Suo Tracker DOES NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE OR Suo Tracker ENTITIES OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICE WILL CREATE ANY WARRANTY REGARDING ANY OF THE Suo Tracker ENTITIES OR THE SERVICE THAT IS NOT EXPRESSLY STATED IN THESE TERMS. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE Suo Tracker ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY MATERIALS OR CONTENT ON OR AVAILABLE THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY Suo Tracker ENTITY HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IN ALL CIRCUMSTANCES IS LIMITED TO AN AMOUNT NOT EXCEEDING $100.00 OR THE AMOUNT OF FEES, IF ANY, PAID BY YOU TO US DURING THE 12 MONTHS PRECEDING THE ACT THAT MAY GIVE RISE TO LIABILITY.

General Conditions

1. You are solely responsible for the content you post on the service. You must ensure that you have all necessary rights, licenses and permissions to post content.
2. Suo Tracker is not responsible for any content you upload. This also applies to any content relating to health, wellbeing and exercise. You acknowledge the risks and dangers associated with this type of content and voluntarily accept them.
3. You understand that Suo Tracker uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service, and that Suo Tracker has no control over these services.
4. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Suo Tracker, or any other Suo Tracker service.
5. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Suo Tracker.
6. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
7. If your bandwidth usage significantly exceeds the average bandwidth usage (as determined solely by Suo Tracker) of other Suo Tracker customers, we reserve the right to immediately disable your account or throttle your file hosting until you can reduce your bandwidth consumption.
8. Suo Tracker does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
9. You expressly understand and agree that Suo Tracker shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Suo Tracker has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
10. You agree to indemnify and hold the service harmless from any claims or damages arising from your content or violation of the terms and conditions. This includes any legal fees or costs incurred by the service in defending against such claims.
11. The failure of Suo Tracker to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. The Terms and Conditions constitutes the entire agreement between you and Suo Tracker and govern your use of the Service, superseding any prior agreements between you and Suo Tracker (including, but not limited to, any prior versions of the Terms and Conditions). You agree that these Terms of Service and Your use of the Service are governed under Armenia law.
